Client(s), for the purpose of these service terms and all requests for service to GetReady Graphics are defined as follows: anyone who submits by email or fax a request for services from A. Agosto/GetReady Graphics. No requests without written verification will be honored.
All clients who give consent to GetReady Graphics to perform a service are assumed to have read these Terms of Service and understand that the service terms listed here may change without notice. All clients are obliged by these Terms of Service.
Web design does not include image procurement or logo design (if you require prices for logo design, kindly request them).
The client hereby acknowledges that the quantifiable commodity being purchased is the time of A. Agosto, the Getready Graphics designer or programmer. If a client outrightly rejects a design or programmed project, the client agrees to pay a service fee of 30% for graphic design pieces and 50% for coded or programmed pieces. In some cases, the client will be entitled to the working files (at the discretion of A. Agosto/GetReady Graphics).
Clients are entitled to a brief consultation prior to any services being performed or payment rendered. This free consultation is quantified as 12 minutes per projected 4 hours of work to be performed and such consultations under one hour will be performed by phone. Any additional consultation time is considered billable time. Any consultaion time under one hour in which the client requires my presence ('face time') is considered billable time and travel time will be assessed to that consultation time.
The completed work will meet the agreed upon criteria and any failure by GetReady Graphics must be evidenced and presented by the client within 30 days of the finalized submission. In the undertaking of any services by GetReady Graphics that the client hereby agrees that all service inquiries and requests are not considered finalized until a documented submission is returned by the client to GetReady Graphics. Suitable documentation is considered to be either email response (GetReady Graphics will hold all email correspondence with a client for 30 days after the final submission of the completed project) or mailed in physical documentation, bearing the client's signature and return address (must be a physical address). It is the responsibility of the client to ensure that such documentation has been received by GetReady Graphics.
I will require approval by email to begin any project and all images and copy you wish included.
I provide ONE visual mock up and the sample can be revised until it's ready to be delivered (there will be additional charges for each additional mock up you wish to choose from in the first round.) - this revision period is effectively unlimited, within reason. A request for a different design is considered separately and not part of the revision process of the first design. Separate designs require the application of an additional charge.
Once approved, construction, development and finalization of the design begins. On completion, the client is sent a screenshot of the active theme or design and sent a paypal invoice. Sites are built locally, so there is ZERO down time for your current site, during the design process.
Once paid, the completed products are delivered. No final products shall be delivered until remittance of the invoice.
At the discretion of GetReady Graphics, an initial service deposit may be applied before any work is performed.
All clients utilizing GetReady Graphics' graphic design services are assumed to own or have permissions to use all submitted images for the purposes of graphic and/or art layouts. GetReady Graphics does not take any responsibility for clearing permissions with the original artists or photographers; this is the sole responsibility of the client. It is recommended that the client take time to clear all permissions relating to the submitted images.
Clients must supply their own images of specified materials such as photos unless they have given permission to Getready Graphics to acquire them. ALL PHOTO ACQUISITIONS REQUIRE A DOWN PAYMENT. This payment shall be equal to the cost of the photos (the client may specify which site or business the photos should be acquired from) plus a service charge, negotiated prior to any service agreement.
Artwork and designs GetReady Graphics submits to its clients will be in an electronic file format. The client is entitled to receive the artwork in a format agreed upon, prior to generation of the design.
It is my guarantee that the original, generated art work for those clients that had no material to submit for a graphic layout will conform to the terms stated by documented agreement, prior to undertaking any work. Upon final submission to the client, after final approval has been given by the client, the product is assumed to be the client's property and GetReady Graphics will not seek to retain any rights over this artwork, or attempt to resell any images or concepts which are a part of it.
Any artwork GetReady Graphics seeks consent to display is solely for the use of example material for clients. All artwork and design not given consent to display will be retained for 30 days. Clients may request duplicate files of their artwork within that time period.
If for some reason the files provided should be faulty, Getready Graphics will replace them without any service charge.
Clients will receive proofs for their projects, which will be in low resolution PDF or JPEG formats. At the time of receipt, the client is allowed to indicate revisions or which design (if multiple proofs were requested) they wish and what revisions they wish to make to the chosen design. Approval for revisions must be sent via email, so there is documentation that the client has given consent to enact the indicated revision work, as well as enumerate the specific details of those revisions.
A client may choose to receive BOTH illustrations as completed artwork for an additional 50% charge.
Clients are entitled to as many minor revisions as necessary to conform to the original client concept on the agreed upon design. It is the duty of GetReady Graphics to retain and record all interactions with the client. No undocumented agreements will be considered and it is advised that the client saves all interactions with GetReady Graphics for future records.
Significant revisions or entirely new art work will be considered at the time of second-round negotiation. Revisions may require an additional service charge beyond the second round of proofing if, after a design is chosen, the client decides upon the need for significantly new artwork. Entirely new art work, photos or illustrations after delivery of the initial product are considered to be separate orders and will require a re-application of the initial service charge (50% of full cost; considered an additional proof). It is the responsibility of GetReady Graphics to consult with the client on this matter before generating any new material and no new charges will be applied nor new services rendered without client consent to additional services as stated above.
Graphic Designers who have outsourced their work to GetReady Graphics should be advised of the following stipulations:
Any paid for work that is part of a firm's or individual's occupational process that will be declared at the end of any fiscal year must be declared to GetReady Graphics. The client MUST supply a 1099 tax contract.
GetReady Graphics does not and will not offer the following services for Printed Book Layout Formatting: Proof Reading, Content Editing, Spell Checking and/or Book Printing. These are the sole responsibility of the author/publisher and any agents the client approaches for these services.
GetReady Graphics receives no payments for referrals from service vendors whom the clients are referred to and owns no responsibility for any damages, disagreements, or breeches of contract between those parties. It is the client's responsibility to investigate any other sources approached for services not being directly offered by GetReady Graphics.
GetReady Graphics does not take any responsibility for damages occurring to the manuscript for which the client or printing service utilized are culpable. The client has the right to insist on the adjustment or repair of any errors incurred or damages to the file or format for which GetReady Graphics is responsible. This service exists up to ten business days from final submission of the product and it is the client's responsibility to check all documents submitted upon receipt.
GetReady Graphics will not knowingly unlawfully disseminate, or aid in the dissemination of any written content that contains or espouses exploitive and/or abusive material directed at minors. It is the sole discretion of GetReady Graphics to qualify this content in the event that it is encountered and any images or material which does so will be turned over to federal authorities for review. Nor does GetReady Graphics claim responsibility for any content printed or published by authors serviced by GetReady Graphics that contains content which may be construed as racially or sexually hostile to citizens protected under federal or local statute. I do not proof read the material, nor do I knowingly qualify content, unless it is obvious to be said material, in which case local or federal authorities may be contacted if the material proves to violate laws protecting children or citizens protected under federal or local laws.
